Don't think so. I remember my car with split boots getting passed before. CV grease could get onto the brakes which would be deemed a safety issue. Prolly depends on the place.

From memory they will fail spit boots but not clicking CV joints. However it's worthwhile sorting it out anyway as I think it can be a safety issue - from experence.
An old car of mine nearly went into a tree when the joint snapped. A mate was driving I was in the passenger seat (gotta love those non-drinkers) and it pulled the wheel from his hands.
