Kurariki avoids jail for assault

I want to know why, when someone is on parole the stance taken by courts - as is the norm elsewhere - that any conviction will automatically cancel that parole and see the person in prison.

Parole is basically a warning - you're out, but ona good behaviour bond. Screw up and you're back in...

How is it that so many people who get convicted of crimes while on parole are then allowed to remain free?

the simple answer is because here in NZ, recall for offending on parole is not automatic

corrections "may" make a recall application - there is a discretion

personally I think any offence punishable by imprisonment should trigger a recall, no application needed

Oh.. I thought it would be. That's why... here's me thinking the judge just had her head in the sand. So, corrections have to apply for it?

Which is why it's the Justice system, not Police, that we have to thank for the criminals on our street

You can almost guarantee that the guy who burgled your house or assaulted you has been caught by the cops before... the Justice system, however, let him back out

yes. or police.

however there was nothing stopping the judge imposing a fresh term of imprisonment by way of sentence for the new charge of assault.

except the judge chose a different sentence: supervision.

corrections would normally make the application however I believe police can also make a recall application. why they don't do this more often, is a mystery to me. lazy? Razz

See I do some research JH!
A while back you mentioned the fear of being caught actually exceeds the fear of sentence for a lot of crimes (so we don't need harsher sentences, but better policing)

Then I looked at the stats for repeat offenders and realised that the P(being caught previously) for a hell of a lot of offence classes would be .5 or higher... so the cops ARE catching them!!!

It's a bit like opposition to bail. Police make them all the time, judges throw them out all the time.

yeh they do. but some police bail opps are just stupid. the grounds aren't even there.
